Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, all other terms of this Agreement will continue to apply.
These Terms and any Disputes arising out of or relating to these Terms, the Site, or the Services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania and the United States of America, without regard to conflict of law principles.
Subject to the arbitration provisions in Section 11, you agree that any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania. You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue.

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Alan Construction may assign, transfer, or delegate these Terms and our rights and obligations hereunder without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.
These Terms are for the benefit of, and shall be enforceable by, the parties hereto and their respective successors and permitted assigns. These Terms are not intended to confer any rights or remedies upon any person or entity other than the parties hereto.
Alan Construction shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
The section headings in these Terms are for convenience only and have no legal or contractual effect. The use of “including” means “including without limitation.”
By using the Site or Services, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
You may not use or export any content from the Site in violation of U.S. export laws and regulations. You represent and warrant that you are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
These Terms are drafted in the English language. If these Terms are translated into any other language, the English language version shall control in the event of any inconsistency or discrepancy.
Alan Construction is a licensed contractor in the Commonwealth of Pennsylvania.
All work performed by Alan Construction complies with applicable federal, state, and local laws, codes, and regulations. Specific licensing, bonding, and insurance information will be provided in separate written contracts for Services.
While Alan Construction offers emergency roofing services and strives to respond promptly to urgent requests, we cannot guarantee immediate availability or specific response times. Emergency service requests are subject to weather conditions, crew availability, and other factors beyond our control.
In the event of a roofing emergency, you should also contact your insurance company and take reasonable steps to mitigate damage to your property.
Warranty information for materials and workmanship will be provided in separate written contracts for specific Services. Any warranties are subject to the terms, conditions, and limitations set forth in such contracts and in manufacturer warranties for materials used.
The information on the Site regarding warranties is for general informational purposes only and does not constitute a warranty offer or guarantee.
By requesting Services or providing information through the Site, you may be asked to consent to the use of photographs or images of your property for marketing purposes. Such consent will be obtained separately and is not a condition of receiving Services.
